Leftist Lawyers’ Plan To Block Trump Certification Defies Will Of The People

Two leftist lawyers have unveiled a dangerous scheme to prevent President-elect Donald Trump from taking office, despite his decisive victory in the 2024 election. Evan Davis and David Schulte, writing for The Hill, argue that Congress should disqualify Trump under the 14th Amendment, a move that disregards the Constitution and the choice of American voters.

The lawyers claim Trump engaged in “insurrection” against the Constitution, using three flimsy arguments to support their claim. First, they cite his second impeachment trial, during which seven Republican senators voted to convict him. However, the Senate’s acquittal reaffirmed that the evidence did not meet the threshold for conviction.

Their second point relies on the Colorado Supreme Court’s decision to disqualify Trump from the state’s ballot, which was invalidated by the U.S. Supreme Court. The high court ruled that states lack the power to bar federal candidates, making the Colorado decision irrelevant.

Finally, the lawyers reference findings from the highly criticized January 6 Committee. Allegations of witness tampering and misrepresentation of evidence have cast serious doubt on the committee’s credibility. Even the House Oversight Committee concluded that there is no evidence Trump incited chants of “Hang Mike Pence!” or knew of plans for violence.

Davis and Schulte suggest that Congress reject Trump’s electoral votes, enabling Kamala Harris to become president. This proposal not only disregards the Constitution but also denies Americans their right to choose their leader.

By advancing this plan, these lawyers betray the voters’ will and promote a dangerous precedent that undermines the foundations of democratic governance.
